ARTICLE 1 - PERFECTION OF TERMS.

Our sales are subject to these general conditions prevailing on any conditions of purchase, except formal exemption and express our part.

These general conditions of sale are systematically sent or given to each purchaser upon delivery of the products and are available on our online sales site for it to order. Therefore, the placing of an order implies acceptance by the buyer of these terms and conditions, to the exclusion of all other documents such as brochures or catalogs issued by the seller and have an indicative value

Orders are not final until they have been confirmed in writing and after payment is made according to the means offered online.

ARTICLE 2 - PRODUCT AVAILABILITY.

On receipt of your order, we check the availability of the product ordered.

In case of unavailability, we are committed within 30 days from the confirmation of the order:

  • to deliver the ordered product,
  • or to offer a similar product for your needs,
  • or to refund you.

If out of stock on one of the products, the order remains awaiting shipment

ARTICLE 3 - ORDER OF TREATMENT:

The order will be validated:

  • The order date if paying by credit card online
  • At the time of cashing the check when paying by check
  • the transfer of the date of receipt on the bank account of K2M DISTRIBUTION (K2M SERVICES Sàrl) in case of payment by transfer.

ARTICLE 4 - ORDER PAYMENT:

Payment is made directly through the bank. Payment by credit card is perfectly secure, your order will be recorded and confirmed upon acceptance of payment by the bank.

Via your PayPal account: PayPal lets you pay online without sharing your financial information during the transaction.

By check: Your order is reserved for 7 days. Beyond this period, without receiving your check will be canceled. The order will be processed upon receipt of your check and after validation by our services.

By bank transfer: Your order will be processed upon receipt of your payment and after validation by our services.

With POSTAL BANK: You can choose to pay: In a time with Debit, in several monthly installments.

ARTICLE 5 – DEFAULT OF PAYMENT:

K2M DISTRIBUTION (K2M SERVICES GmbH) reserves the right to refuse delivery or to deliver an order from a customer who has not fully paid or a previous order or with whom a payment dispute is being processed.

ARTICLE 6 - TIME AND DELIVERY OF GOODS:

The delivery time if the material is in stock is 2-14 days the mode of transport.

Delivery will be made by La Poste in colissimo or carrier depending on the weight and volume of the product. For deliveries by courier, check, in the presence of the delivery person, number, status, and the contents of your parcel. In case of damage found, you must state with details of the date, the damage and make reservations on the delivery note.

Failing this, no complaint will be considered. It is the buyer to provide any justification as to the reality of defects or anomalies noted.

ARTICLE 7 - DELIVERY COSTS.

Shipping fees are calculated based on their weight and the delivery method selected at the checkout. Delivery costs agree postage and packing included.

The delivery is offered from an order value over 500 € *. Valid only in France.

ARTICLE 8 - OWNERSHIP RESERVE CLAUSE:

The products remain the property of K2M DISTRIBUTION (K2M SERVICES Sàrl) to the total collection of the customer's payment.

The seller retains ownership of the goods until payment of the full price in principal and accessories. The customer is therefore prohibited, in case of incomplete payment, to dispose of goods to resell or process them.

The customer is obliged to immediately notify the seller of any difficulties that may lead to its failure, of all seizures by third parties of products.

These provisions do not prevent the transfer to the buyer upon delivery, risk of loss and damage of goods sold and the damage it may cause.

It is expressly agreed that any deposit paid will be forfeited to the seller as damages.

ARTICLE 9 - GUARANTEES AND RESPONSIBILITIES:

A - Manufacturer Warranty

When the product has a manufacturer's warranty, this is indicated in the data sheet. The manufacturer's warranty is usually two years. Only replacement of defective parts are supported.

In case of failure during the initial warranty period, repairs will be performed free of charge by the national network of centers or technical agencies approved stations by manufacturers. Only the shipping charges will be your responsibility.

To qualify for this warranty, it is imperative to keep the purchase invoice of the product.

The Guarantee does not apply to:

  • Goods not eligible for this contract
  • Damages, failures, malfunctions or defects due to causes of external origin (improper application of the equipment, electrical surge ...)
  • Failures resulting from the modification of the construction and original features of the device
  • The failures of non-conforming parts to those recommended by the manufacturer
  • The settings available to the beneficiary without disassembly
  • Commissioning costs, adjusting, cleaning and non-consecutive tests at a guaranteed damage
  • Failure to follow the manufacturer's instructions
  • Repairs and damage to the unit after repair by persons other than authorized repair by the manufacturer
  • The makeshift or temporary repairs and the consequences of the possible aggravation of the damage resulting
  • Damages due to corrosion, a bad connection or a power problem
  • Damage due to a power problem, is meant by power problem, not an internal power problem product, but this one external.

It is recalled that the benefit of the manufacturer's warranty does not preclude the application of legal provisions relating to the legal guarantee of conformity and the guarantee against hidden defects (legal guarantees) reproduced below.

B - Legal Guarantees

You benefit from the provisions of the legal guarantee of compliance and the guarantee against hidden defects, under the Consumer Code and the Civil Code:

Compliance:

Article L211-4 of the Consumer Code:

The seller must deliver goods in conformity with the contract and liable for defects of conformity existing upon delivery. It also answers the lack of conformity resulting from the packaging, instructions for assembly or installation when it was put to him by the contract or was carried out under his responsibility.

Article L211-5 of the Consumer Code:
To comply with the contract, the product must:

1) Be suitable for the purpose usually associated with such a product and, where applicable:

  • Match the description given by the seller and possess the qualities that he has presented to the buyer as a sample or model
  • Present the qualities that a buyer can reasonably expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labeling

2)  Or present the characteristics defined by mutual agreement by the parties or be suitable for any particular purpose for which the buyer made known to the seller and the latter accepted.

Article L211-12 of the Consumer Code:

The action resulting from lack of conformity lapses two years after delivery of the goods.

To benefit from this warranty, please contact our customer service by email directly from the site DISTRIBUTION K2M (K2M SERVICES Sàrl). To facilitate and accelerate the process flow, a return number will then be assigned, which should indicate when returning the product. You can choose between the replacement or repair of the product returned. However, under Article L 211-9 of the Consumer Code, if the option you have selected results in a disproportionate cost, we will use the other option.

If however no repair or replacement available, or if the solution you choose can be implemented within one month of your claim, or if this solution has a major drawback for you given the nature of the property and the use you are looking for, you can then request the cancellation of the contract. This resolution will not be imposed if the defect is minor. If the resolution is passed, the price will be refunded within 14 days of receipt of your return. 

Hidden defects:

Article 1641 of the Civil Code:
The seller must guarantee in respect of hidden defects of the thing sold which render it unfit for the use for which it was intended, or that decrease this use that the buyer would not have acquired it, or not have paid a lower price if he had known.

Paragraph 1, Article 1648 of the Civil Code:
The action resulting from latent defects must be brought by the purchaser within two years after discovery of the defect.

To facilitate and accelerate the process flow, a return number will then be assigned, which should indicate when returning the product. A breakdown and origin check is performed upon receipt of your product. The returned product, if it is affected by a defect, will be refunded including shipping, or exchanged according to your demand and availability.

C - Responsibilities

K2M DISTRIBUTION (K2M SERVICES Sàrl) cannot be held responsible for the partial implementation of contract, due to the occurrence of a force majeure event. This force majeure may, depending on the circumstances, if any total or partial strike of postal services, carriers, and disasters caused by flood or fire.

Regarding products purchased to meet the business needs, K2M DISTRIBUTION (K2M SERVICES Sàrl) shall not be liable for all damages because of this, business interruption, lost profits, damages or expenses that may arise. The selection and purchase of a product are under the sole responsibility of the customer.  

ARTICLE 10 - RIGHT OF WITHDRAWAL.

Pursuant to Article L 121-20 of the Consumer Code, you have a period of 14 days from the receipt of goods to retract without reason and return the products to us. If this deadline expires on a Saturday, Sunday or a holiday or holiday, it is extended to the next business day. Beyond this period, no withdrawal will be accepted.

You can exercise your right to cancel by mail from the site DISTRIBUTION K2M (K2M SERVICES Sàrl). To facilitate and accelerate the process flow, a return number will then be assigned, which should indicate when returning the product.

To be returned, the product must be complete, specific to a new market, and returned in complete original packaging. You support the product return costs.

ARTICLE 11 - TREATMENT OF PACKAGES: IASP / UNCLAIMED / REFUSED.

If your package is returned by our service provider for the following reason:

  • IASP (Do not live with the Address Indicated)
  • Unclaimed parcels during its pendency period
  • Parcels refused by the addressee on delivery
  • After receipt and acceptance of the return, we will proceed to a refund by check, transfer your credit card.

ARTICLE 12 - ACT PROVISIONS "COMPUTER AND FREEDOMS"
